“Two things were clear during Wednesday’s oral arguments in Benisek v. Lamone, a challenge to Maryland’s gerrymandered congressional maps. The first is that there are almost certainly five justices who think the maps need to go.

There is “no other reason” for drawing a map that is all but sure to elect seven Democratic members of Congress and only one Republican, “other than partisanship,” Justice Stephen Breyer declared. Justice Anthony Kennedy compared the map to a state constitution that explicitly required maps to be draw to discriminate against one party. When the Court briefly got caught up in a discussion of how much partisanship is too much partisanship in the redistricting process, Justice Elena Kagan cut that discussion off.
“However much you think is too much, this case is too much,” Kagan said of the Maryland gerrymander.”*

  1. Why not have both parties redraw these districts rather than whoever is in power at that particular time, that way both parties can argue over whatever is fair. It's just like election time when you have both parties count the ballots, but in this case one party precounts the ballots.

  2. I think the best way to eliminate gerrymandering and get as close to equal representation as possible is by adding seats to the House of the Representatives. The best way to do this is by either taking the state with the smallest population, dividing its total population by 3 House and using that population number as the baseline to apportion seats to each state so that a state with 5 times that base population getting 5 seats, 12 that number getting 12 seats etc. The size of the House of Representatives has not been increased in nearly 100 years and that has dramatically shifted the balance of power.

  3. Is it really that hard? Maybe I'm stupid but here in Sweden you get the proportional number of politicians from a party depending on the number of votes in that certain district. Can't you just in for example a state election count the whole state and distribute them just proportional to the votes in the whole state? Kind of like how your popularity votes work. Wouldn't a system like that kill gerrymandering? Maybe it is an utopia…

  4. The fact that your arguing on how to cut stolen land completely pointless. Talking that republic took the best areas when the original owners are still getting screwed for letting you heathens stay. Broken every contract and agreement you ever made in state or country.

  5. Just abolish districting. There IS NO "fair" way of making political minorities of any geographical region, however large or small in whatever shape, a political non-entity. Making a district look like how most people USUALLY vote just entrenches the status quo, AT BEST.

  6. Hey John, you know you said there is no excuse for "a lack of inaction". Damn those supreme court justices for their "lack of inaction." And Mark, seriously, a hoodie and a suit jacket, the hood looks like some kind of neck adornment.

  7. I live in Maryland, and I tell you straight up that for a Democrat to win in western Maryland, someone had to take a few trucks of ballots to a pit and literally torch them in the middle of the night. The dems are central around Baltimore, but definitely NOT anywhere in western Maryland.

  8. I am against all gerrymandering and if this case rules again the dems is also means that ll the republcon states that gerrymandered their states will have to redraw the districts. If that happens then the republicons will lose all across the country.
